Terms of Service
These terms govern your access to and use of IncomeCalculator.com. Please read them carefully — by using the Service you agree to them.
Important: IncomeCalculator.com is a decisioning and productivity tool for licensed mortgage professionals. It is not a lender, is not a credit decision, and is not a commitment to lend. You remain responsible for verifying every result against the applicable agency, investor, and regulatory guidelines.
These Terms of Service (the “Terms”) are a binding agreement between you and IncomeCalculator.com (“IncomeCalculator,” “we, ” “us,” or “our”), a service operated by Hancock Processing LLC, governing your use of our website and income-analysis service (the “Service”). If you are using the Service on behalf of a company, you represent that you have authority to bind that company to these Terms.
1. Eligibility & accounts
The Service is intended for licensed mortgage professionals and other business users who are at least 18 years old and located in the United States. You agree to provide accurate account information, keep your credentials secure, and remain responsible for all activity under your account. Notify us promptly of any unauthorized use.
2. The Service; license
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business purposes during your subscription. You may not resell, sublicense, reverse engineer, or use the Service to build a competing product, and you may not exceed the usage levels of your plan through automated or abusive means.
3. Subscription, free trial & billing
Plan
The Service is offered on a single flat plan at $99 per month (USD), which includes roughly 150 income analyses per month. This allowance is intended to cover normal professional use; we may apply reasonable measures to address sustained use that materially exceeds it (see “Acceptable use”). Prices are in U.S. dollars and exclusive of any applicable taxes.
Free trial
New accounts may start with a 5-day free trial. A valid payment method is required to begin the trial. Unless you cancel before the trial ends, your subscription will automatically convert to a paid monthly plan and your payment method will be charged the then-current price.
Auto-renewal
Subscriptions renew automatically each month until cancelled. By subscribing, you authorize us and our payment processor to charge your payment method on each renewal date until you cancel.
Cancellation
You may cancel at any time from your account settings or by contacting us. Cancellation stops future renewals. When you cancel, you will retain access through the end of the current paid billing period, after which your access ends. To avoid being charged for the next period, cancel before your renewal date (or before the trial ends).
Refunds
Except where required by law, fees are non-refundable, and we do not provide refunds or credits for partial months, unused analyses, or periods during which your account remained open but unused. The free trial is provided so you can evaluate the Service before being charged.
Failed payments & price changes
If a charge fails, we may retry the charge and may suspend or downgrade your access until payment succeeds. We may change our pricing or plan features prospectively; we will provide reasonable advance notice of any price increase, and continued use after the change takes effect constitutes acceptance of the new price.
4. Acceptable use
You agree not to use the Service to:
- violate any law, regulation, or third-party right;
- upload information you are not authorized to submit, or that you do not have the necessary consents to provide;
- attempt to gain unauthorized access to the Service, other accounts, or our systems;
- interfere with or disrupt the integrity or performance of the Service; or
- circumvent usage limits, share a single account among multiple individuals, or otherwise abuse the included monthly allowance.
5. Your data & documents
You retain all rights to the documents and data you submit (“Your Content”). You grant us a limited license to process Your Content solely to provide the Service to you. You are responsible for the accuracy, legality, and quality of Your Content and for having the authority and consents needed to submit it (including any borrower information). Our handling, retention, and deletion of documents are described in our Privacy Policy, which is incorporated into these Terms.
6. Professional-use disclaimer (financial services)
The Service produces income calculations and supporting narratives to assist your work. It does not provide legal, tax, financial, underwriting, or compliance advice, and it is not a credit decision or a commitment to lend. Agency, investor, and regulatory guidelines change and vary by program. You are solely responsible for:
- independently verifying every figure and conclusion the Service produces;
- confirming the applicable Fannie Mae, Freddie Mac, FHA, VA, Non-QM, DSCR, or other investor requirements for each loan; and
- complying with all laws and regulations governing your activities, including fair lending and consumer-protection laws.
You must not rely on the Service as the sole basis for any lending, underwriting, or qualification decision.
7. Service availability
The Service is provided on an “as is” and “as available” basis. We do not guarantee that it will be uninterrupted, timely, secure, or error-free, and we may modify, suspend, or discontinue features, or perform maintenance, at any time.
8. Disclaimer of warranties
To the fullest extent permitted by law, the Service is provided without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that any calculation, narrative, or citation produced by the Service is complete, current, or correct for your specific use.
9. Limitation of liability
To the fullest extent permitted by law, IncomeCalculator and its operators, owners, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Service. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the amounts you paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless IncomeCalculator and its operators from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, Your Content, your violation of these Terms, or your violation of any law or third-party right.
11. Suspension & termination
We may suspend or terminate your access if you violate these Terms, fail to pay, or use the Service in a way that risks harm to us, other users, or third parties. You may stop using the Service at any time. Provisions that by their nature should survive termination (including payment obligations, disclaimers, limitations of liability, and indemnification) will survive.
12. Governing law & disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. The state and federal courts located in Maricopa County, Arizona will have exclusive jurisdiction over any dispute not subject to other agreed dispute-resolution terms, and you consent to their jurisdiction and venue.
13. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Effective date” above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
